ProfiLegal dispute resolution team, led by Partner Vadym Matiushko, successfully protected the client’s interests and unlocked a decade-long suspension of enforcement of a court decision worth over UAH 2 billion.
Based on the arguments and evidence presented by ProfiLegal, the court recognised the validity of the client’s (the creditor’s) reasons for missing the statutory deadline for compulsory enforcement. The court established that, over the past years, the client had consistently and in good faith taken steps to enforce the decision. Still, actual enforcement was impossible due to multiple arrests and encumbrances imposed on the mortgaged property.
ProfiLegal demonstrated that between 2014 and 2022, enforcement of the decision had been blocked by the debtor’s actions, including numerous court proceedings, arrests, and injunctions. Only in 2025 did the court change the enforcement method, enabling compulsory execution in accordance with the Law of Ukraine “On Enforcement Proceedings.”
