ProfiLegal Defended the Interests of a Kharkiv-Based Gambling Business in a Dispute with Law Enforcement Authorities

ProfiLegal’s dispute resolution team, led by Partner Vadym Matiushko and involving Attorney-at-Law Khrystyna Yaniv, successfully defended a Kharkiv-based gambling business in a case brought by the Prosecutor’s Office. The prosecutors, acting on behalf of the Commission for the Regulation of Gambling and Lotteries (CRGL), sought to recover over UAH 62 million in alleged license fee arrears. These claims related to the period of martial law, despite the fact that the client’s gaming halls in Kharkiv had ceased operations and were later destroyed due to the war.

In late 2021, the client paid nearly UAH 60 million in licensing fees for the entire following year. However, from 24 February 2022, the business was suspended due to the full-scale invasion. Later, the premises were damaged beyond use as a result of hostilities.

ProfiLegal developed a comprehensive legal strategy. It involved challenging the jurisdiction of commercial courts and proving that the law enforcement agency had exceeded its authority.

The courts ruled in favour of the client.
