ProfiLegal Secures Release of Frozen Funds for Two Companies

ProfiLegal’s White-Collar Crime Practice, led by Managing Partner Yuliia Kalova and Attorney-at-Law Alina Oleksiuk, successfully protected the clients’ interests and secured the release of funds frozen in the bank accounts of two leading retailers.

The restrictions imposed within the framework of criminal proceedings resulted in the complete freezing of the companies’ bank accounts. This prevented them from carrying out business activities and meeting ongoing financial obligations.

During the consideration of the motions, the court agreed with the lawyers’ arguments that:

  • there was no sufficient evidence linking the funds to the subject matter of the alleged criminal offence;

  • there was no evidence of the companies’ or their officers’ involvement in a criminal offence;

  • the applied measure effectively transformed from a procedural asset freeze into a complete blockage of bank accounts and business operations.

The court separately considered the principles of reasonableness and proportionality of interference with property rights. It also noted the temporary nature of asset seizure as a measure to secure criminal proceedings.

As a result, the asset freezes were lifted, and the companies fully resumed their financial and business operations.
